INTRODUCTION AND DEFINITIONS
("ProximCloud"), ("Us"), ("We"), ("Company"), ("Website"), ("Site"), (“Proxim”), (“ProximHosting”) , (“Proxim.Cloud”), agrees to provide services to the ("Client"), ("Customer"), ("You"), subject to the following ("Terms of Service"), ("Terms"), ("Conditions"), ("Agreement").
Account details you have provided to us must be correct, accurate and up-to-date, this is required by law. We are legally required to terminate any services where account details do not meet any of the above. In order to register to the site, you are required to have a valid email address. You may not use, or allow any individual to use an account which is not listed under their name. People that would like to have client area access should have their own account, or be added as a contact. When ordering Website Hosting from ProximCloud, you are only renting the hosting. All Website Hosting packages are to remain property of ProximCloud.
We will not activate any products ordered from ProximCloud until a payment has been received on our end, and until it is verified not to be fraudulent or suspicious. Payment verification is usually automatic, but sometimes it requires a manual review by higher staff. Invoices are generated 14 days before the due date, these should be paid a few days before the due date. Products / Services renew on the due date, regardless of the payment date. If you fail to make a payment before the due date, your service will be suspended immediately. We are not liable for any data loss if your service is suspended due to late payments.
If your account is terminated due to a violation of these terms and conditions, a refund will not be provided under any circumstances.
All website hosting packages are eligible for a refund, within 24 hours of payment for the service. Only the first payment for the hosting package is covered by this. Further refunds are only made if you experience an issue which cannot be resolved by ProximCloud. Please do note that we do not offer refunds on any Domains purchased. (This can vary, so please contact us via our ticketing system for more information, for certain cases)
We attempt to ensure all services are available 24 hours a day, 7 days a week for as long as you have paid for them. We do rarely have occurrences where our services may be unavailable to you. We will attempt to compensate all clients affected. We will provide the agreed amount of money via credits, or additional days to your desired plan. ProximCloud will provide detailed and accurate incident reports if this does occur.
CANCELLATIONS AND DISPUTES
In order to cancel your services, you must issue a cancellation request within the clientarea, https://proxim.cloud/billing/clientarea.php. You must ensure that you manually cancel any active PayPal subscriptions that were created when ordering your service from ProximCloud. We do not have access to deduct funds from your PayPal account, and will not be held responsible for automated payments made from a subscription. We highly recommend contacting us before opening a PayPal dispute, as issues can be resolved quickly and a refund can be provided if you fit the requirements above. If you do open a PayPal dispute, we have the right to suspend or terminate your service(s) without warning.
USAGE OF SERVICES
We will not be held responsible for any third party software uploaded to our services. Unauthorized usage, such as attempting to access or interfere with other clients data will be result in an immediate termination of your services without any warning. You may not purposely bypass any limits / restrictions that your service is provisioned with, such as the Bandwidth or Storage. Attempting to do so will result in an instant suspension without refund. In the event your usage exceeds the limits of your service, the process exceeding these limits may be automatically disabled without notice. Your usage must be reasonable and should not place excessive loads on our hardware or resources. You must not store non-related files on your services storage.
ProximCloud is under no circumstances to be held liable for any data loss, disruption of information, or disruption of information including but no limited to that of unauthorized access to our server systems or any other loss of data. We will not be held liable for delays or failure in performance caused by acts of war, terrorism, labor dispute, fire, act of government or any other cause beyond our control. ProximCloud shall not be held liable for any disruption, delay or disconnection of services for any period of time. We reserve the right to restrict, alter or modify fees, benefits, rules, regulations, promotions, terms and conditions or terminate services at any time without notice.
ProximCloud does not put a hard limit on the amount of bandwidth able to be used for our Deluxe plan, all services are still subjected to software limitations and physically hardware limits.
Any support requests required for products or services from ProximCloud are to be submitted through tickets, emails and live chat. All other form of contact is not guaranteed a proper answer from an official representative and may be ineffective. Support is only provided through these methods due to the ability to log support requests for training and security purposes.
